Watch What You Post On Social Media If You Work In A Health Care Facility!

Spectrum Health System, in Grand Rapids, and an emergency department physician who was terminated by Spectrum are headed to mediation to resolve their differences. The Hospital believes the emergency department physician violated HIPAA. The dispute began when an emergency department nurse posted a photo of a woman’s backside. Believing the woman in the photo was someone she recognized in public and in the emergency department, the emergency physician posted “OMG. Is that TB?”
Upon the physician’s termination, she filed a lawsuit against Spectrum Health System and administrative personnel in U.S. District Court. The Court has ordered the parties to mediation as means of resolving their differences out of court. The mediator, a neutral third party, facilitates the discussions between the parties, assisting them in identifying a resolution to their dispute. Mediation is a particularly beneficial dispute resolution process because it helps parties who will most likely work together going forward, by assisting the parties in constructive communication and limits the antagonism usually seen in the courtroom.
