Electronic Health Record Incentive Program – Are You Feeling More Breathing Room?

On September 4, 2014 the Centers for Medicare & Medicaid (“CMS”) published a final rule to give eligible healthcare providers more leeway in complying with the Electronic Health Record Incentive Program. With the publication of the final rule eligible healthcare providers may, in 2014, use either the 2011 edition of the certified EHR technology (“CEHRT”) or a combination of the 2011 and 2014 editions. Beginning in 2015 the 2014 edition of CEHRT will be required to be used. The final rule also extended compliance with Stage 2 Meaningful Use through 2016.
For healthcare providers who first became meaningful Electronic Health Record users in 2011 or 2012, they will have until 2017 to demonstrate Stage 3 compliance. CMS has provided resources to assist eligible healthcare providers in understanding these changes.
