Case Study – Professional Licensure

A client landed her prized job on a specialty unit in a large heath care system. Unfortunately for her, the more senior staff members on the unit were not very welcoming. The existing staff members were unwilling to assist the client with her patients and wrote her up for alleged misconduct and inadequate care. The client was eventually terminated, and her termination was reported to the Department of Licensing and Regulatory Affairs. A licensing investigation was initiated. Based on false information provided during the investigation and the facility’s refusal to turn over subpoenaed medical records, an administrative complaint was issued against the client’s license, alleging she violated the public health code.
With an administrative licensing sanction facing the client, the licensing board initiated talks to resolve the case. Given that the client did nothing wrong, misinformation was provided to the investigator and the facility refused to produce pertinent portions of the medical records, talks to resolve the matter where delayed. Eventually medical records were provided by the facility, which exonerated the client. The licensure action was dismissed and the client continues to have an unblemished license.
